Terms of Use

1. The Service

Lydiana is a personal AI fashion stylist for women. The Service may include digital wardrobe tools, personalized outfit recommendations, AI chat styling, virtual try-on, weather-aware suggestions, and related features. Features may change, improve, or be discontinued over time.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. If you are under the age of majority where you live, you represent that you have parental or guardian consent. You are responsible for the accuracy of the information you provide and for keeping your account secure.

3. Accounts

You may need an account to use certain features. You agree to provide accurate information and not to share your login credentials. You are responsible for activity under your account. Notify us promptly if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

• Use the Service for unlawful, harmful, harassing, or abusive purposes.
• Upload content you do not have the right to use, or that infringes others’ rights.
• Upload illegal content, or content depicting minors in a sexual or exploitative manner.
• Attempt to reverse engineer, scrape, disrupt, or overload the Service or its AI systems.
• Circumvent fair-use limits or automate excessive AI requests.
• Misrepresent your identity or affiliation, or use another person’s account without permission.
• Use Lydiana to build a competing product using our outputs or systems in an abusive way.

5. Your Content

You retain ownership of photos, messages, and other content you submit (“User Content”). You grant BuildLaunch a worldwide, non-exclusive, royalty-free license to host, process, analyze, display, and otherwise use User Content as needed to operate, improve, and provide the Service, including by sending relevant content to AI and infrastructure providers.

You represent that you have all rights necessary to submit User Content and that it does not violate law or these Terms.

6. AI Features and Disclaimers

Lydiana uses artificial intelligence to analyze clothing images, generate styling advice, and create virtual try-on visuals. AI outputs may be inaccurate, incomplete, or stylistically imperfect. Recommendations are for inspiration and personal use only; they are not professional fashion, medical, or safety advice. Always use your own judgment about clothing, fit, weather, and occasions.

7. Subscriptions and Payments

Some features may require a paid subscription. Purchases are processed by Apple App Store, Google Play, and/or Adapty under their terms. Prices, billing periods, and available plans are shown at the time of purchase. Subscriptions renew automatically unless canceled according to the store’s instructions. Refunds are handled by the applicable app store’s policies, except where required otherwise by law.

8. Fair Use Limits

To keep Lydiana reliable and available for everyone, AI-powered features are subject to fair-use limits. The same limits apply to weekly and monthly subscription plans. Allowance resets on a rolling 30-day period beginning when your usage period starts (not a calendar month). Unused allowance does not roll over to the next period.

During each rolling 30-day period, you may use up to the following (subject to change with notice in the app or these Terms):

• 30 virtual try-ons
• 50 closet item scans (digitization of clothing photos)
• 100 stylist chat messages
• 100 outfit analyses (match scores)

9. Fair Use Enforcement

When you reach a limit, that feature pauses until your next 30-day period begins. Circumventing limits, automating excessive requests, or otherwise abusing AI systems is prohibited and may result in suspension or termination. We may adjust fair-use thresholds to protect service quality; material changes will be reflected in these Terms and/or communicated in the app.

10. Intellectual Property

The Service—including the Lydiana name, branding, design, software, and original content—is owned by BuildLaunch or its licensors and is protected by intellectual property laws. Except for your User Content, you may not copy, modify, distribute, or create derivative works from the Service without our prior written permission.

11. Third-Party Services

The Service relies on third-party platforms such as Apple, Google, Clerk, Convex, Adapty, and analytics providers. Your use of those services may also be subject to their terms and privacy policies. We are not responsible for third-party services we do not control.

12. Termination

You may stop using the Service at any time and may request account deletion. We may suspend or terminate access if you violate these Terms, misuse the Service, or if we discontinue the Service. Upon termination, your right to use the Service ends, though provisions that by nature should survive will survive.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS WILL MEET YOUR EXPECTATIONS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILDLAUNCH AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.

15. Indemnity

You agree to indemnify and hold harmless BuildLaunch and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.

16. Changes to the Terms

We may update these Terms from time to time. We will post the updated Terms in the app and/or on our website and revise the “Last updated” date. If you continue using the Service after changes take effect, you accept the revised Terms. If you do not agree, stop using the Service and delete your account.

17. Governing Law

These Terms are governed by the laws of the jurisdiction in which BuildLaunch principally operates, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence apply.
