These Terms of Service (“Agreement”) apply to your use of the Lydiana website, marketing pages, and the Lydiana mobile application offered by BuildLaunch (“we,” “us,” or “our”). By accessing our website or downloading Lydiana, you agree to this Agreement and our Privacy Policy.
1. Agreement to Terms
This Agreement forms a binding contract between you and BuildLaunch. If you do not agree, do not use the website or the Lydiana app. Your use of the mobile application is also subject to our Terms of Use, which describe acceptable use, accounts, subscriptions, and AI features in more detail.
2. Description of the Service
Lydiana is a personal AI fashion stylist for women. Through the app you may digitize a wardrobe, receive outfit suggestions, chat with an AI stylist, preview try-on looks, and receive weather-aware recommendations. The website provides product information and links to download the app from Apple App Store and Google Play.
3. Accounts and Access
Certain features require creating an account and completing onboarding. You are responsible for safeguarding your credentials and for activity under your account. We may refuse, suspend, or limit access where we reasonably believe there is fraud, abuse, or a violation of this Agreement or the Terms of Use.
4. Downloads and App Stores
The Lydiana app is distributed through Apple App Store and Google Play. Additional store terms apply to downloads, purchases, billing, and refunds. BuildLaunch is not responsible for store outages, account issues on those platforms, or store policy decisions outside our control.
5. Subscriptions
Premium features may require a paid subscription billed through Apple, Google, and/or Adapty. Pricing and renewal terms are shown at purchase. Cancel or manage renewals in your store account settings. Except where required by law, refunds follow the applicable store’s policies.
6. Fair Use Limits
AI-powered features in the Lydiana app (including virtual try-on, closet digitization scans, stylist chat messages, and outfit analyses) are subject to rolling fair-use limits that apply equally to weekly and monthly plans. Current default allowances per rolling 30-day period are up to 30 try-ons, 50 closet scans, 100 stylist messages, and 100 outfit analyses. Unused allowance does not roll over. 7. Intellectual Property
All Lydiana branding, website content, software, and original materials are owned by BuildLaunch or its licensors. You may not copy, scrape, mirror, or commercially exploit the website or app without prior written permission, except for personal, non-commercial use of the Service as intended.
8. Privacy
How we collect and use personal information is described in our Privacy Policy. By using the Service, you acknowledge that processing described there, including AI processing of images and messages you submit.
9. Disclaimers
THE WEBSITE AND SERVICE ARE PROVIDED “AS IS.” STYLING AND TRY-ON OUTPUTS ARE FOR INSPIRATION AND MAY BE INACCURATE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILDLAUNCH WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY ARISING FROM THIS AGREEMENT OR THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE PRIOR 12 MONTHS OR USD $50.
11. Changes
We may update this Agreement by posting a revised version on the website and updating the “Last updated” date. Continued use after changes take effect constitutes acceptance. Material changes to paid features will be communicated where required by law or store policy.
